Judgments
|
A money Judgment is a ruling of the court that establishes the legality of a debt. The judgment will establish the amount, and will usually include whatever interest and penalty the judge feels is correct according to the evidence. If you are sued and you don't show up, a default judgment will be issued against you. The process begins when a creditor gives up on trying to convince you to pay. They then file a lawsuit for the monies owed. A summons must be served on the debtor by hand or certified mail. You will be given a certain amount of time to answer the complaint. You should act quickly and file your answer promptly. Even after a judgment, the creditor or their lawyers are almost always open to a payment plan. If you continue to ignore them at this stage, they can take the judgment to the court and have a writ of execution issued
